Terms and Conditions

These Terms and Conditions govern your access to and use of the Makvix website, customer portal, digital products, communications and related services operated by Mohammad Kazem for Trade and Investment SPC, trading under the Makvix brand.

By accessing the website, creating an account, placing an order, requesting a service or otherwise using Makvix, you agree to these terms. If you do not agree, please do not use the relevant service.

Makvix operates from Al Khawd, P.O. Box 111, Al Seeb, Muscat Governorate 112, Oman. General enquiries may be sent to makvixco@makvix.com or made by phone at +968 76930400.

Makvix may provide websites, mobile applications, custom software, AI automation, ERP solutions, IT consulting, branding, hosting, maintenance, digital products and related services. Availability, scope, timelines and pricing may differ between services and customers.

Website descriptions are general information and are not a binding quotation. A project becomes binding only when the parties approve the applicable proposal, order, statement of work, subscription terms or other written agreement.

You must provide accurate information and keep your contact details current. You are responsible for activity carried out through your account and for protecting access to your devices and communication channels.

Makvix uses email one-time passcodes to verify account access. A verification code is confidential, short-lived and must not be shared. We may delay, limit or block repeated requests that appear automated, abusive or unsafe.

Notify us promptly if you believe your account, email address or verification channel has been compromised.

Prices may be shown in Omani rial or another stated currency. Taxes, transaction charges, third-party licences, hosting, domains and other external costs may be listed separately unless expressly included.

Online checkout payments on Makvix are processed through Tap Payments. By continuing to payment, you authorize Tap Payments and the relevant payment network or issuer to process the transaction under their applicable terms. An order may be paused or cancelled if payment is declined, reversed, overdue or suspected to be unauthorized.

Refunds, cancellation rights and renewal terms are governed by the applicable order, proposal, subscription details, our Refund Policy and mandatory consumer law. When an eligible Tap-paid transaction is refunded, Makvix submits the approved refund through Tap Payments against the original payment where supported. Digital work already performed, third-party purchases and custom deliverables may not be refundable unless otherwise agreed or legally required.

For custom projects, you agree to provide timely access, content, approvals and accurate requirements. Delays in customer feedback or third-party access may affect delivery dates.

• You confirm that materials supplied to Makvix may be lawfully used for the project.
• You are responsible for reviewing and approving deliverables, content, calculations and business rules before production use.
• Changes outside the agreed scope may require a revised price or timeline.
• Third-party services remain subject to their own availability, pricing and terms.

You may not use Makvix services to:

• Break the law, infringe intellectual-property rights or violate another person’s privacy.
• Transmit malware, exploit vulnerabilities, bypass access controls or interfere with service availability.
• Send spam, deceptive communications, unauthorized bulk messages or abusive automated traffic.
• Attempt to obtain another user’s password, one-time passcode, token or confidential information.
• Use AI-assisted services to generate or distribute unlawful, fraudulent or harmful material.
• Misrepresent your identity, authority or relationship with another person or organization.

We may restrict access where reasonably necessary to protect users, infrastructure, legal compliance or service integrity.

The Makvix name, logo, website design, original text, software, graphics and other materials are owned by Makvix or its licensors and are protected by applicable intellectual-property laws.

Custom-project ownership and licence rights are governed by the applicable proposal or project agreement. Unless expressly transferred in writing, Makvix retains ownership of pre-existing tools, reusable components, frameworks, know-how, templates and general development methods.

You retain ownership of content you lawfully provide, while granting Makvix the limited permission needed to use that content to perform the requested service.

Makvix may integrate or link to third-party platforms such as Tap Payments for online payments, Meta and WhatsApp for supported communication features, hosting and cloud providers, app stores, analytics tools and AI providers. Those services are controlled by their respective operators and may change or become unavailable without notice.

Makvix is not responsible for third-party terms, privacy practices, outages, account restrictions or independent decisions. You are responsible for complying with any third-party terms applicable to your use.

We aim to provide reliable services but do not guarantee that every feature will be uninterrupted, error-free or compatible with every device or third-party platform. Maintenance, security updates, infrastructure incidents and external-provider failures may affect availability.

Except for commitments expressly stated in a signed agreement or required by law, Makvix services are provided on an “as available” basis. No website statement creates a guarantee of a particular commercial result, ranking, revenue, approval or regulatory outcome.

To the maximum extent permitted by applicable law, Makvix will not be liable for indirect, incidental, special or consequential loss, loss of profits, loss of data, business interruption or damage caused by a third-party service.

Where liability cannot be excluded, Makvix’s aggregate liability relating to a paid service will be limited to the amount paid to Makvix for the specific affected service during the period giving rise to the claim, unless a greater amount is required by law or expressly agreed in writing.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

You may stop using the website at any time. Account, subscription or project cancellation may remain subject to the applicable agreement and outstanding payment obligations.

We may suspend or terminate access where there is a material breach, unlawful conduct, security risk, non-payment, abuse of communication systems or a requirement from an authority or platform provider. Where reasonable, we will provide notice and an opportunity to resolve the issue.

These terms are governed by the laws of the Sultanate of Oman. Subject to any mandatory dispute rights, the courts of Muscat, Oman will have jurisdiction over disputes relating to these terms or the website.

We may update these terms to reflect service, legal or operational changes. The revised version will be posted with a new “Last updated” date. Continued use after an update means the revised terms apply from the stated date.
